Criminal Cases: Mitigation Pleas: Facts Relating To The Offence

The mitigation plea is the written or oral presentation to the Court of your mitigation factors.

After you have been found guilty and convicted of an offence, the Court will need to consider what type and amount of sentence to impose against you.

Have you been accused of committing a criminal offence? Are you involved in a criminal investigation or Court case?

Did you know that before the Court decides on and imposes the sentence, you will be given an opportunity to inform the Court of any mitigating factors which you may have?

the authorities may take a different (and possibly more lenient) type of action against you if you have repaid or returned the money that was stolen or taken from the victim?
