A 51-year-old man, an Indian national and married construction worker was sentenced to six years and six weeks’ jail after pleading guilty to committing a non-consensual sexual act on another man.
- He pleaded guilty in the State Courts of Singapore. He pleaded guilty to one count of performing a sexual act without his victim’s consent.
- At the material time, the man walking back to his dormitory after a drinking session in 2017 and saw the 29-year-old man sleeping at a staircase landing. He went over and stroked the man’s groin before pulling down the victim’s trousers and then performing oral sex on him. The victim, an Indian national, woke up and punched the man who then ran away.</li
- The Court did not impose caning on the man because he is over 50 years old.
- It is unclear whether he was represented by a Criminal Defence Lawyer during the presentation of his mitigation plea and when the Court imposed the sentence.
Sexual assault involving penetration is an offence under section 376 of the Penal Code (Cap 224) which states:
Sexual assault involving penetration
376.—(1) Any man (A) who causes another man (B) to penetrate with B’s penis, the anus or mouth of A —
(a) without B’s consent; or
(b) with or without B’s consent, when B is below 14 years of age, shall be guilty of an offence.
A person convicted of this offence can be punished with imprisonment for a term of not less than 8 years and not more than 20 years and shall also be punished with caning with not less than 12 strokes.
